Manhattan Beach plastic bag ban rejected by Los Angeles County Superior Court

(Feb 08, Los Angeles) The Los Angeles County Superior Court ruling is a victory for the retail stores and restaurants in Manhattan Beach - as the ban would have only increased operational costs and caused more harm to the environment. The Manhattan Beach violated the California Environmental Quality Act by not fully analyzing the ban's potential environmental effects before approving it in July. The Los Angeles County Superior Court Judge David Yaffe cited that the city must consider the proliferation of paper bags, a likely result of banning plastic bags, could threaten the environment. “The judge said the city is required by law to do an environmental impact report because there is a fair argument that there would be a substantial impact on the environment,” said Manhattan Beach City Attorney Bob Wadden. “There's a potential impact from the fact that more paper will be used.” Manhattan Beach was incorrect to assume their initial cursory review was sufficient enough to determine a ban would not negatively affect the environment.

It is disappointing when cities do not do their research before attempting to pass legislation... Surely they would have found the negative impacts that banning plastic bags would have on the environment.
